Federal Loan Consolidation: Qualifying and Benefits

The idea that financial aid from the federal government gives individuals and businesses an unfair break holds no water. Even if they are designed to help, these loans can be eventually put the borrower in a lot of debt if they are not properly managed. This is why it can become necessary to turn to a federal loan consolidation program.
These programs have a lot of advantages, not least because they can rescue the borrower from the point of bankruptcy. Generally speaking, these loans are available at lower rates of interest and with more flexible repayment terms. So, getting loan approval can provide a huge boost to those that really need it.
The idea of taking out a loan to repay other loans may seem strange, but by properly managing the debt created by federal loans, the deal can be perfect. This is because it buys out the existing loans with one easily managed loan.
Federal vs Private Programs
There are two different breeds of consolidation programs to avail of - namely, privately and federally provided programs. The main difference is based on interest rates, with the consolidation programs from private lenders generally more expensive to pay back. Federal loan consolidation programs, on the other hand, are less expensive because of the lower interest charged.
The challenge of getting loan approval is not as great when applying for federal programs, simply because qualifying comes down chiefly to financial hardship. When applying to private lenders, the ability to repay remains the priority, so the chances of rejection when repayments are already hard to meet, are very low indeed.
Of course, when looking to consolidate federal loans, the best port of call is a federal program. It is better to seek a private program when the source of the loan is private too. This is because the mix of private and federal is not generally beneficial.

Qualifying for a Consolidation Loan
The process of qualifying for a federal loan consolidation program is dependent on the type of loans secured, and whether they are federal or private. When it comes to seeking approval on a program, it is necessary to be in debt to the federal government through their past funding offers. But chiefly agriculture and business are the two areas that are affected.
Farmers and agricultural workers who have taken out FSA issued Farm Loans, Commodity Marketing Loans, Ownership Loans to alleviate their economic difficulties, and Farm Storage Loans all qualify for consolidation. Getting loan approval may depend on how far behind the applicants are financially.
Any businesses that have taken out federally sponsored financing packages are also allowed to seek a federal loan program. What is important, however, is the ability to meet monthly repayments.
Securing a federal loan package depends on whether a natural or economic incident was suffered. Or it may be deemed necessary to get funds to have upgrade work done on the business facilities, for example. Poor credit management might make life difficult but a consolidation program can help borrowers regain a financial foothold.

Nevadans are equally divided over whether homeowners who owe more on their homes than they are worth should purposely refuse to pay their mortgages, according to a report released Thursday by the Nevada Association of Realtors.

The report, Nevada's Face of Foreclosure, stated that in an April survey of 500 individuals undergoing, recently experiencing or narrowly avoiding foreclosure 45 percent approved of strategic defaults. An equal percentage said homeowners have a legal and ethical obligation to pay their mortgages if they are able.

The survey, with a 4.9 percent margin of error, also found that 27 percent of respondents experiencing foreclosure engaged in strategic default, and 53 percent had lost their job within the past 12 months.

The report included results from a second survey of adults contacted randomly from March 29 through April 2 and also came with a video presentation."

SAN DIEGO -- Home foreclosure activity in California has fallen to five-year lows, easing concerns there might be a flood of distressed sales to slow or even reverse the housing market's recovery.
There were 54,615 default notices filed on houses and condominiums from April through June, down 3.6 percent from 56,633 during the second quarter of last year, according to research firm DataQuick. It was the lowest tally since the second quarter of 2007 and down 60 percent from the peak of 135,431 in the first quarter of 2009.
An improved housing market and a "burning off" of loans from the peak of the housing bubble between 2005 and 2007 has contributed to the drop, DataQuick said. Also, more homeowners with troubled mortgages are turning to "short sales" -- transactions in which the sales price is below the amount owed on the property.
The numbers provide more evidence that California's housing market is on the mend even as doubts persist that foreclosures may rise again.
"The big caveat is there are still a lot of people in trouble and it's not clear how many will be foreclosed upon," DataQuick analyst Andrew LePage said Tuesday"

Many people that are considering filing bankruptcy typically look at every alternative in an effort to avoid the process. There is so much bad press out there on the damage it does to one's credit that most people do everything they can to avoid a bankruptcy filing at all costs. Typically, when an individual contacts a bankruptcy lawyer and has a consultation they will do a brief evaluation of one's finances to see if that person would even qualify to file Chapter 7 bankruptcy. After the changes the bankruptcy code back in 2005, an individual filing Chapter 7 is required to pass a means test to qualify. Basically, the means test takes a six month look back timeframe from the month prior to the bankruptcy filing. The bankruptcy lawyer will then divide it by six and multiply by 12 giving them the average annual income for that individual. The bankruptcy lawyer will compare the household income against the median income chart for the state in which the person resides. If the person makes less than the median income for that state, they would most likely qualify to file Chapter 7 bankruptcy. There is much more to the formula and is one of the reasons it's important to be represented by an attorney for the process.
Most bankruptcy attorneys will always look for alternatives to filing bankruptcy when an individual first contacts them. They are in the business to help someone and not to collect fees for someone that doesn't need to file for bankruptcy. After a quick evaluation, a bankruptcy lawyer should be able to see if a person could just do some budgeting that would allow them to be able to pay the debt off and avoid filing bankruptcy. The bankruptcy lawyer will usually add up the total amount of unsecured debt and ask the debtor to budget their household income to see how long the debt would take to pay off if they stop charging at that time. If it takes longer than five years, the person might be a candidate for filing Chapter 7 bankruptcy. They want people to seriously look at not living beyond their means and to cut the ties with the credit cards. If they file for bankruptcy, they will be forced to live without credit cards for probably at least a year. If the debt is small enough, why not avoid filing bankruptcy and buckle down and pay these guys off.

Mortgage Foreclosures Make Lenders Get Back Their Money


Mortgage foreclosure is a process connected with housing loans. Banks and other financial institutions lend home loans to borrowers, when they buy a home either for their own occupation or as an investment. Generally the repayment years of these home loans are 10 years; 15 years and 30 years. Every home loan is processed on application from the home buyer-borrower and after scrutinizing the documents related to the credit worthiness; financial standing; present and future household income of the applicant; documents relating to the property proposed to be purchased etc. before sanctioning the amount. A written agreement called "mortgage deed" (or deed of trust in some States) is entered into between the lender and the borrower.

It is this mortgage deed that defines the terms and conditions of the home loan - amount of loan; interest rate; years of repayment; amounts of monthly installments; and the rights of the lender to take action in case of non-payment of the home loan. Mortgage foreclosures are governed by Foreclosure Laws of the State. There are two types of foreclosure proceedings permitted by the law. One is to initiate and proceed with the foreclosure process through the County Court. This is judicial foreclosure. The other one is non-judicial foreclosure carried out of Court through a Trustee. State foreclosure laws permit either one or both foreclosure proceedings.

The object of mortgage foreclosure in both the cases is to sell off the property pledged as security, against the home loan at the time of borrowing, in the event of non-payment of monthly installments by the borrower-home owner, to get back the outstanding home loan. The foreclosure process commences after issuance of a Notice of Default by the lender to the borrower, to pay the arrears of payment and reinstate the home loan within a time frame. According to the terms mentioned in the mortgage deed, the lender sends a Notice of Default after filing a law suit against the borrower in the County Court (otherwise known as Lis Pendens) or a Recorded Notice after recording it in the local Recorder's office.

The Court passes an order for a Sheriff Sale public auction of the property concerned, on a specific date and time, for Mortgage foreclosures routed through Court in the event of borrower not responding. Similarly in the case of non-judicial foreclosure, a Trustee Sale public auction is scheduled to take place in a given date and time.

It should be noted here that mortgage lenders try to use foreclosure as a last resort, because it is expensive and time consuming. Before that, they are ready to compromise with the borrower in many ways - forbearance of lapsed installments; modification of the loan terms - rate of interest; years of repayment; refinancing the loan with some other lender; allowing a short sale by the home owner to settle the dues etc.

Mortgage foreclosures end up in disposing off the properties through public auction by a Sheriff Sale or Trustee Sale, where the highest bidder gets the property. In the event of the minimum bid not forthcoming, the lender repossesses the property against the loan dues to realize money by resale.

In any case mortgage foreclosures ensure that the lenders get back their money, sooner or later.

As your situation changes it will be time to move to the next bigger home in a nicer neighborhood and then again and again until it's time to stop or trade down. Take your time your first house won't be your last house unless you stretch to far away from a real livable budget and fall into foreclosure.
